1. Introduction
These Terms and Conditions govern every interaction a customer has with the Cineviz platform, including browsing, purchasing, communicating with support, and engaging with any of our digital or printed materials. By using the Cineviz website or placing an order, the customer acknowledges that they have read these terms in full and agree to be bound by them without exception. These terms define the rights, responsibilities and expectations applicable to both Cineviz and the customer, and they serve as the foundational framework under which all transactions and website activities are conducted.
2. Brand Identity and Usage of Trade Expressions
For the purpose of clarity, the term “Cineviz” refers collectively to all forms of branding, labels, product markings and creative expressions that may appear on books, packaging or digital properties, including variations such as Cineviz Works or any similar naming used for creative presentation. These descriptors do not represent separate entities and should be understood as part of the same brand identity. Customers agree that any reference to the brand within these terms applies universally to all such expressions without distinction.
3. Ownership of Intellectual Property
All creative content associated with Cineviz, including illustrations, artwork, book content, designs, packaging, logos, products, digital media files, layouts, website elements, and any associated intellectual property, is the exclusive property of Cineviz. No part of this intellectual property may be copied, reproduced, recreated, distributed, published, or otherwise used for commercial or non-commercial purposes without written permission from Cineviz. Customers acknowledge that all rights remain with Cineviz and that they may not claim, modify, distribute, repurpose or exploit any such material in any form.
4. Use of Products for Personal Purposes Only
Products sold by Cineviz are intended exclusively for personal use. Customers may not resell, redistribute or commercially exploit the products without explicit prior authorisation. Any attempt to use Cineviz products for commercial gain, bulk resale, unauthorised distribution or promotional purposes without written consent constitutes a violation of these Terms and Conditions. Cineviz reserves the right to take appropriate action if its products are misused or circulated in a manner that harms the brand’s integrity or commercial interests.
5. Acceptance, Review and Cancellation of Orders
Cineviz reserves the right to review, decline or cancel orders at its discretion, particularly in situations involving unusual purchasing patterns, potential misuse, suspected fraud, incorrect payment information, unserviceable destinations or discrepancies in the details provided by the customer. An order is considered accepted only after Cineviz confirms it for processing. If Cineviz identifies any issues during order verification, it may cancel the order and refund the amount paid using the same method used by the customer. Cineviz is not obligated to provide justification for rejecting or cancelling an order when such action is necessary to maintain operational integrity or prevent misuse.
6. Accuracy of Product Content and Natural Variations
Cineviz strives to provide accurate descriptions and visual representations of its products. However, customers understand that books are printed products and may contain natural variations in paper texture, ink density, colour shade, finishing and other attributes associated with the printing process. Such variations do not constitute defects and do not qualify for refund or replacement. Additionally, minor aesthetic changes between printed batches may occur due to inherent limitations in mass-production settings. Customers agree that their expectations of product consistency should take these natural variations into account.
7. Warranty Limitation and Scope of Responsibility
All books and printed products sold by Cineviz are provided without any form of warranty, whether express or implied. Products may display characteristics associated with printing, binding, transportation or handling, and these should not be interpreted as deficiencies unless they materially affect the readability of the book at the time of delivery. Cineviz’s responsibility extends only to delivering the product in a condition suitable for reading. Beyond this, Cineviz does not entertain warranty-based claims regarding quality, longevity, aesthetic appearance, content satisfaction or subjective preferences. Customers acknowledge that no warranty is offered or implied in any form.
8. Limitation of Liability
Cineviz is not liable for delays, disruptions or failures arising from circumstances beyond its control, including courier delays, regional restrictions, weather disturbances, supply chain issues, operational challenges faced by logistics partners, or any event that reasonably prevents timely delivery. Cineviz’s liability in any scenario is limited strictly to the value of the product purchased. Under no circumstances will Cineviz be responsible for indirect, incidental, special or consequential damages arising from the use or non-use of its products or services. Customers agree that the maximum extent of Cineviz’s responsibility ends with providing the product they purchased or refunding the transaction when applicable under policy conditions.
9. Responsibilities of the Customer When Using the Platform
Customers are responsible for providing accurate information during checkout, including their name, address, contact details and any other information necessary to complete their order. Customers must ensure the details provided are correct and updated, as Cineviz cannot compensate for losses arising from customer errors, including incorrect addresses or unresponsive contact numbers. Additionally, customers must monitor their shipment once dispatched and coordinate with the courier to ensure successful delivery. Failure to do so does not entitle the customer to a refund or replacement.
10. Fraud Prevention, Order Misuse and Unauthorised Activities
Cineviz maintains strict controls to prevent fraud, misuse and unauthorised activities on its platform. Any behaviour that suggests chargeback misuse, payment fraud, unauthorised resale, repeated exploitation of refund systems, submission of manipulated evidence or misuse of promotional offers may result in immediate cancellation of orders and the permanent restriction of the customer’s access to the platform. Cineviz reserves the right to take necessary action, including legal intervention, if it detects attempts to defraud the system or harm the brand’s operations.
11. Disruptions, Force Majeure and External Circumstances
Cineviz cannot be held responsible for delays or disruptions arising from events outside its operational control, which may include natural disasters, political disturbances, public emergencies, courier shutdowns, unforeseen regulatory changes, or any other situation that reasonably interrupts normal business operations. Customers acknowledge that such events may extend delivery timelines or temporarily affect service availability without entitling the customer to a refund or compensation.
12. Updates to Terms, Pricing and Website Information
Cineviz reserves the right to update or modify its Terms and Conditions, product pricing, availability, dispatch timelines, and website information without prior notice. The website always reflects the most accurate and updated information, and customers are encouraged to review the terms periodically. Any continuation of platform use or placement of new orders after updates signifies acceptance of the revised terms.
13. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the applicable laws of India. Any dispute arising from the interpretation or application of these terms shall fall under the exclusive jurisdiction of the courts located in Hyderabad, Telangana. Customers agree to resolve any concerns through appropriate legal channels as governed by local regulations.
By accessing the Cineviz website, engaging with its features or placing an order, the customer confirms that they have read, understood and agreed to all provisions of these Terms and Conditions.
